1. Functioning of the website www.thetrendyluxe.com / Contractual relationships
1.1 Via www.thetrendyluxe.com website, THE TRENDY LUXE offers a shop for second hand designer fashion. This website can be accessed on the Internet under the domain www.thetrendyluxe.com and thetrendyluxe.com. THE TRENDY LUXE can to provide other access options to the THE TRENDY LUXE website via connections to other services via so-called applications (apps).
1.2 Users must create an account on www.thetrendyluxe.com to enter into a contract with the items presented on the THE TRENDY LUXE.
1.3 While entering data or information, the respective user can correct or delete his or her entries using the standard keyboard or mouse navigation.
1.4 Users registered on www.thetrendyluxe.com can act as buyers of items for sale and view photographs and descriptions of the items in advance.
2. Registering as a user / deleting a user account
2.1 The use of the services on the THE TRENDY LUXE website requires buyers to register as users and to create a user account associated with said registration. There is no entitlement to the registration of a user account. A user account is non-transferable. A buyer can create one user account only.
2.2 Registration is only permitted to individuals with unlimited legal capacity. Minors in particular, are not permitted to register on the THE TRENDY LUXE website.
2.3 The information requested by THE TRENDY LUXE during registration must be indicated in full and to the best of the user’s knowledge. This includes first and last name, the current address (excluding POBs), a valid E-mail address and telephone number.
2.4 When registering, the user must choose a password. The user is obligated not to disclose his or her access data to third parties and to take appropriate measures to maintain confidentiality of said data and to prevent the misuse of his or her user account by third parties.
If the user has any indications that his or her user account is being or was misused by any third party. He or she is obligated to immediately notify THE TRENDY LUXE using the following E-mail address: info@thetrendyluxe.com.
THE TRENDY LUXE will not disclose a user’s password to any third party and will never request a user’s password via E-mail or telephone.
2.5 THE TRENDY LUXE has the right – but is not obligated – to delete a user account if the user has not accessed his or her user account for more than six months. THE TRENDY LUXE will inform the user ten work days prior to the expiration of the aforementioned period via E-mail that – unless the user accesses his or her user account within the next ten work days – the user account will be deleted. A user with a deleted user account can re-register as a user.
3. Buying a sales item / Conclusion of contracts
3.1 To purchase a sales item on the THE TRENDY LUXE website, a buyer registered at THE TRENDY LUXE can click the “add to cart” button, to place said item into his or her shopping cart. This is the first step of the buying process and not binding on any of the parties. Before the buyer submits a binding offer, the buyer has the option of reviewing all information he or she provided and the sales items placed in the shopping cart and if necessary, of correcting and/or removing sales items out of the shopping cart. The user does not place a binding offer until clicking the “Buy” button. Following this, the buyer receives a confirmation of the receipt of his or her offer to buy.

5.1 The www.thetrendyluxe.com website is operated and maintained by THE TRENDY LUXE.
5.2 THE TREND LUXE will strive to make the wwww.thetrendyluxe.com website available to the users as well as the public with an annual availability average of 95%. Downtimes, which are used for the improvement, redesign and/or optimisation of the THE TRENDY LUXE website (software updates, improvement of security, redesign or optimisation of the content and presentation) and technical measures (server maintenance) are not taken into account for the aforementioned annual average.
General Terms and Conditions
1. Buyer’s right of cancellation after concluding a sales contract for a sales item
1.1 If the buyer is a consumer with his habitual residence in one of the EU member states, he benefits from the legal right of withdrawal without giving reasons. The cancellation period is fourteen (14) days from the date on which you or a third party designated by you, other than the carrier, take possession of the goods.
If the customer places an order by selecting the click & collect delivery option and takes possession of the item at THE TRENDY LUXE head office, the right of withdrawal is not applicable.
If the buyer is located outside the EU, the right of withdrawal is not applicable.
If you order an Entrupy certificate of authentication, it is not refundable in accordance with the laws on digital goods.
1.2 The notification of cancellation must be sent to THE TRENDY LUXE by email to returns@thetrendyluxe.com. We will send you a withdrawal form to include in the return package.
We will ONLY accept your return when you respect the following points:
• The safety tag “THE TRENDY LUXE” is still attached.
• The withdrawal form completed, dated and signed.
• Each item is unused and bears no sign of wear
• The original packaging and paper is included and is in good condition.
• The original tags and labels are attached and are in good condition
In the event that one or more points are not respected, we will refuse the return. You will be required to pay delivery costs in advance in order to collect the item. This will be kept in our premises.
Return delivery costs are the responsibility of the customer. THE TRENDY LUXE recommends using a known company, which provides proof of delivery (DHL, BPOST, DPD, registered with acknowledgment of receipt, etc.)

CONSEQUENCES OF CANCELLATION
If you cancel this contract, we must return all payments we have received from you, excluding delivery charges within 10 days after we receive the item. You must return or hand over the goods as soon as possible and in any event no later than fourteen days from the date on which you or a third party designated by you, other than the carrier, takes possession of the goods.
5. Prices / Payment terms
5.1 All prices shown on the THE TRENDY LUXE website for a sales item are final prices in Euro including the respectively valid and applicable value added tax and excluding corresponding shipping costs.

The buyer can choose from the listed payment methods. THE TRENDY LUXE reserves the right to add other payment methods in the future or to refrain from using payment methods, which it currently offers.
6. Shipment of the sales item / Delivery periods / Shipping costs
6.1 Shipment of the sales item.
When the customer places an order and receives the order confirmation, THE TRENDY LUXE usually ships the order within 1-3 days (Business Days).
THE TRENDY LUXE ships orders with various delivery services such as Bpost, DHL PARCEL, DHL EXPRESS, FEDEX. All orders are shipped with a tracking number and insurance covering the entire order.
6.2 Delivery periods
For Belgium, Delivery time usually amounts not more than 2 work days.
For Europe deliveries, delivery time is usually not more than 3-5 days.
For international deliveries, delivery time is usually not more than 4-10 days.
In the event that the delivery times given by THE TRENDY LUXE are exceeded, only the customer can contact the delivery service to request information on delivery.
THE TRENDY LUXE is in no way responsible for delivery times and/or delays. THE TRENDY LUXE refers to the information given by delivery services. No refund or compensation can be requested in the event of delay.
6.3 Shipping costs
You will receive an electronic order confirmation on your screen and per e-mail when your payment has been made.
In case of a refund, we will credit the card or bank account of the person who paid for the products.
7. Warranty / Statute of limitations / Liability
In accordance with European second-hand warranty laws, THE TRENDY LUXE applies a one-year legal warranty for all purchases.
